Lasting Power of Attorney

The Lasting Power of Attorney (LPA) bill provides for people to appoint attorney to act on their behalf if they should lose capacity in the future.  This is similar to the old Enduring Power of Attorney (EPA) but the Bill also allows people to choose an attorney to make health and welfare provisions.

An LPA must be set out in the form prescribed by the regulators.

Registration – the powers given in an LPA to the done cannot be exercised until the document has been registered with  the Public Guardian.
